Displaying RSS feeds on your website (a.k.a. “syndicating”) is an easy way to get an automated stream of fresh content for your site. But is it ethical? There are two questions involved:

1) Are you “injuring” the publisher of the content?

2) Are you “injuring” third parties?

(Disclaimer: I’m not a lawyer. This article should not be considered legal advice).

Since you’re reproducing content someone else owns the copyright to, #1 is both a legal and an ethical question. And not everyone agrees on the answer.

Since RSS invented for syndication, some argue that publishing an RSS feed implicitly authorizes others to syndicate it. In most cases, if you syndicate in a way that benefits the publisher, that seems to be a safe assumption.

A few generally accepted rules for syndicating ethically include:

1. not syndicating feeds that expressly forbid it and honoring all requests to stop

2. not syndicating the full content of full-content feeds (just display excerpts from each item)

3. always linking to the original source of the content

4. linking in a way that’s counted by the search engines (don’t use ‘rel=”nofollow”‘ or JavaScript links)

5. caching the RSS feed on your server so you won’t use the publisher’s bandwidth to reload it whenever someone loads your webpage (this speeds your website up too)

If you follow rules 2, 3 and 4, you “pay” the publisher for their content by:

* sending traffic to their site (you can make the links open in a new browser window if you want)

* giving them a boost in the search engines by giving them in-bound links (this can help you too since the search engines like sites that link to related content)

What about third parties? Consider how syndication affects the search engines: are you wasting their resources by making them index duplicate content? Or are you syndicating in a way that adds value and helps them find the best content for their users?

Here are a few ways to use RSS feed content that add value:

1. Syndicating RSS feed items that were hand-picked for quality and relevance along side valuable, related, original content.

2. Syndicating RSS feeds that were hand-picked for quality alongside original content. Since only the feed is hand-picked, not each individual item, the value is a little lower than #1.

3. Syndicating search-based content from an aggregator that ranks the quality of the search results alongside original content (for example, using quality-ranked blog search results as opposed to items listed in random or time-based order).

4. Aggregating hand-picked related items from multiple feeds (with no original content).

5. Aggregating multiple hand-picked, related RSS feeds (no original content).

Anything less doesn’t add value, wastes resources, and doesn’t pass ethical muster. For example:

* Syndicating randomly selected, related RSS content alongside original content (regardless of the quality of the RSS content).

* Syndicating any RSS content alongside poor quality content to get the poor content ranked higher.

* Syndicating unrelated content alongside any content to get the content ranked higher (which might work since auto-updating content increases the freshness of the page).

* Publishing pages built solely of content from a single RSS feed (no matter what the quality — it’s purely duplicate content).

* Publishing pages built solely of content aggregated from multiple feeds without regard to quality (bringing together multiple sources of related content can be useful, but only if it’s useful content).

Syndication is a great way to deliver quality content to your site’s visitors. Just be sure to do it ethically.

As a professional home inspector, who has to try to make my way around seller’s houses without things falling on my head or being broken, I can honestly say that I wish that sellers knew more about what to inspect at a home inspection. A home inspector is not there to critique housekeeping — unless it is really bad housekeeping. Minor details like that will be unreported in most cases. A home inspector, also, is not there to look for minor blemishes on the interior paint or to use a torpedo level to straighten the wall hangings. Some sellers expect an inspector to breeze through the inside of the house in an hour and to not look at much else. Fat chance!

The professional home inspector is hired to find the big issues. And, to achieve that goal, the inspector will need access to the outside of the home, and the perimeter of the property, to view siding and components. The inspector will, in most cases, need to go up on the roof and go inside the attic access. The inspector needs to remove the covers on the furnace and the main electric panel and any electric sub-panels. There must be a view of, and access to, the water heater. An inspector will go inside various rooms so a seller locking a dog in a room is problematic for the inspector who may be held accountable for things that he or she was not allowed to view. The inspector needs to be able to look under all sinks (beware what personal belongings are readily visible) and he or she will look in fireplaces and wood stoves. It is essential that the inspector must be able to go into any crawl space or basement areas to look for signs of damage or structural issues. If there is an attached garage, on premises, then the inspector needs full access to that area as well.

The inspector is not a furniture mover, so having a dozen boxes under the attic hatch, or firewood stacked in front of the crawl space door, will not help the process nor speed-up the inspection. In case someone was to think that an inspector is lazy, for not moving belongings, that is not the crux of the matter: When belongings or furniture are moved around, that can lead to breakage and the inspector does not want to break the seller’s personal items or damage the property. The job of being an inspector is hard enough to begin with, without resorting to the blame game and assorted bad feelings.

It would be helpful if seller’s agents would let their sellers know what is expected of them, and their house, at the time of a home inspection. A brief checklist, and overview, that I prepared is below.

Crawl space access: Find out where the hatch is located. It might be concealed, or even under a carpet in a closet. It must be accessible.

Attic access: Make sure that it is accessible and that an inspector can get a ladder up into it without damaging belongings.

Electric panels: Find out where they are located and see to it that there is sufficient room so the inspector is able to remove the covers on all panels.

Water heater: Find out where it is located and make sure it is accessible.

Furnace, A/C, etc: The inspector needs to be able to view the components and remove covers.

Sinks: They must be accessible so the inspector can view drains, traps, piping and look for leaks.

Utilities: If a buyer expects a detailed inspection, then electricity, water and, as applicable, gas must be in-service at the time of the inspection. In a related matter, if the main water shut-off is concealed, such as in a closet obscured by storage, tell the inspector where it is located.

Last month in Part 1, I discussed several of the reasons that have lead the residential real estate mortgage industry to the crisis it faces; at its core in my view, is the whole notion of originators being commissioned sales type ‘closer’ personalities, a relatively recent concept.

As we work our way through today’s industry wide mess, out the other side should emerge a wiser group of survivors, hopefully YOU will be one of them.

The benefits of replacing LO’s and AE’s ‘big fat commissions’, and instead offer a more traditional salary + modest bonus structure, will result in a great number of improvements to the new organizations that ‘make it.’

Considering all that went wrong these past several years since ‘big fat commissions’ were common, history won’t repeat itself with the absence of such available excessive personal gain as has been commonplace, plus the positives will be numerous. On the plus side we have:

A). The effect of better management control over it’s employees, since as W-2 salaried people, owner/operators and managers will be more careful on who they hire and how much they’ll invest in training and how closely they’ll supervise their activities. Not so many loose cannons poking around in the unsupervised darkness.

B). With this payroll structure, those LO’s & AE’s won’t be so quick to “close’ every applicant on a STATED Wage Earner 100% Option Arm with a 4 point YSP; this difference will surely result in overall better quality originations in the long run.

C). These better trained and now salaried employees, will work towards creating an improved credibility environment for themselves and their employers, and move away from the ‘big fat commission’ concept of putting their own selfish interests ahead of the customer’s.

D). There will be far fewer thinly capitalized organizations, as this payroll structure will provide for a larger remaining checkbook balance for employers after payday. With that they can/will have better furniture, fixtures and equipment for their employees, better employee benefits and significant cash available to advertise their products.

E). This model also insures that new owner operators will begin their operations with a significant financial investment. Therefore their outlook will be to establish and maintain at the core, a more ethical and solid company than many of the fly-by-night operators we can see today on both the wholesale and retail sides.

This list I’m sure you can add to as well as I can. What I describe here isn’t a ‘pipe-dream” it’s what I saw with my own two eyes, my first 30 years in this industry; it’s how my first employer operated, and how I operated for several decades also.

Returning to this way of operations naturally is not the solution to all our problems, but it will mitigate future ones a great deal; as well as help restore the former luster we all had as home loan providers.

If on the other hand, you’re left standing after this cleansing is over, and you are in a position within your own organization to make these payroll changes and you don’t, then you can expect to not receive the benefits A thru E above (and others), but instead you’ll be part of the problem next time.
